Terms of Service

1. Acceptance of Terms

By creating an account or using KataFit, you agree to these Terms of Service. If you do not agree, do not use the app.

2. Eligibility

KataFit is rated 13+. You must be at least 13 years old to use the app. If you are between 13 and 18, you confirm that a parent or legal guardian has reviewed these Terms.

3. Account Registration

You agree to provide accurate information when you create your account, keep your credentials secure, and notify us immediately of any unauthorized use. You are responsible for activity on your account.

4. Subscription and Billing

KataFit offers a Pro subscription with unlimited plan generation, purchased through Apple's In-App Purchase system.

• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
• You can manage and cancel your subscription in your Apple ID's App Store settings.
• Refunds are governed by Apple's App Store refund policy. We cannot process refunds directly.
• Prices may vary by region and are subject to change.

5. License to Use the App

We grant you a limited, non-exclusive, non-transferable, revocable license to use KataFit for your personal, non-commercial use, subject to these Terms.

6. User Content

You provide information about your goals, equipment, fitness experience, dietary preferences, and injuries to generate your plans. You retain ownership of your account information. By providing this information, you grant us a worldwide, non-exclusive license to use it to operate the app and generate your personalized plans.

7. Acceptable Use

You agree not to:

• Use the app for any unlawful purpose
• Reverse-engineer, decompile, or attempt to extract source code
• Use automated systems to scrape or extract data
• Resell, sublicense, or distribute the app or its content
• Misrepresent your identity or impersonate others
• Share your account with another person

8. Not Medical Advice

KataFit provides fitness and nutrition suggestions for general information and motivation only. The app does not provide medical advice, diagnosis, or treatment. Consult a qualified healthcare professional before starting any new exercise or diet program, especially if you have any health condition, are pregnant, or are taking medication.

9. Assumption of Risk

Physical training and dietary changes carry inherent risks, including injury. You understand and assume all risks associated with using the workout and diet plans generated by KataFit. You are responsible for exercising safely, knowing your limits, and stopping if you experience pain or discomfort.

10. Coach Marketplace

KataFit may offer access to a marketplace of human coaches who provide personalized guidance. Coaching services are provided by independent third parties, not by KataLabs. KataLabs is not responsible for the conduct, services, or advice of any coach. Disputes between you and a coach should be resolved directly with the coach.

11. Intellectual Property

The app, its content, design, and underlying software are owned by KataLabs and protected by copyright and other intellectual property laws. The generated plans are intended for your personal use and may not be redistributed.

12. Termination

You may stop using the app at any time and delete your account in the in-app Settings. We may suspend or terminate your account if you violate these Terms or for any other reason at our discretion. Upon termination, your license to use the app ends.

13. Disclaimer of Warranties

KATALABS IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KATALABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to indemnify and hold harmless KataLabs from any claims, damages, or expenses arising from your use of the app, your violation of these Terms, or your violation of any rights of another person.

16. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law principles.

17. Dispute Resolution

Any dispute arising from these Terms or your use of the app will be resolved through binding arbitration in California, except that either party may bring an action in small-claims court for disputes within its jurisdiction. You waive the right to participate in class actions to the extent permitted by law.

18. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top. If the changes are material, we will notify you through the app or by email. Continued use of KataFit after a change constitutes acceptance of the updated Terms.
